The personal data that you released during the login or purchase phase (such as for example your contact data, or relating to complaints, or transaction history) have been processed – as joint controllers, as per information previously published on the Site and shared with you – by Wintex Italia S.r.l., with registered office in Milan, Via Savona 97, VAT No. IT12407301006 (“Wintex”), as licensee of the Sergio Tacchini brand, together with the previous Site manager, Triboo Digitale S.r.l., with registered office in Milan, Viale Sarca 336, Edificio 16, 20126, VAT No. IT02387250307.

Recently Wintex sold to Sergio Tacchini OPERATIONS Inc., with registered office in New York, NY USA, (“ST Inc.”), all the assets and rights related to the trademark regarding the Products sold on the Site, including the domain of the Site. Thus, ST Inc. will get your data, and will process them as an autonomous data controller, in order to allow the continuity of the service - and in particular for the purposes of (i) selling the Products, (ii) administrative management of the orders placed or to be made, with consequent possible contacts aimed at managing the your account, (ii) management of deliveries, as well as (iii) management of complaints - always in compliance with privacy legislation and in particular with EU Reg. No. 679/2016 (the "GDPR"), as specified below.

Following the transfer of data (better clarified below) Wintex will cease processing activities.

What does the transfer from Wintex to ST Inc. mean to me?

This modification essentially means that Wintex ceases to be the Data Controller of your data, and the new Data Controller becomes ST Inc., as better identified and defined above.

The transfer of your personal data is carried out in compliance with the GDPR, and therefore safeguarding the protection and security of the data; in particular, the transfer of your data to the USA (which is a non-EU country) is subject to the "adequate guarantees" identified by Article 46.2.c) of the GDPR, and therefore the signing - between Wintex and ST Inc. - of a "data transfer agreement under standard clauses", as desired by the EU Commission.

What are my data transferred to the USA?

• Contact details, such as name, date of birth, nationality, e-mail address, postal address, telephone number and other personal contact information;
• Personal data that may be contained in communications sent for example to report a problem or to forward requests, problems or observations relating to the web site or its contents
• Information deriving from the surveys that Data Controllers can carry out on the web site for research purposes, where the Data Subject decides to answer or participate;
• Information contained in the email forwarded by Data Subjects to customer service.

• Administrative management of orders placed or to be made, with consequent possible contacts aimed at managing your account;
• Deliveries management;
• Handling complaints.

For all the aforementioned purposes, the legal basis required by the GDPR for the legitimacy of the processing is the execution of a contract or pre-contractual measures that concern you or of which you are a part.

As for direct marketing, the legal basis consists of any consent given.

With regard to "complaint management" purposes, ST Inc. may use the support of qualified technological partners - providing for the use of appropriate coding tools - in order to exploit an innovative artificial intelligence system that allows to offer more advanced and effective solutions, also in your interest, for the purpose of handling complaints and customer assistance.

The data may possibly be shared with third parties providing ST Inc. services, such as:
